Eastside Paddle Club Terms of Service

These Terms of Use (“Terms”, “Agreement”) govern your use of the website eastsidepaddleclub.com and associated digital services. By accessing or using our website or services, you agree to these Terms. If you do not agree, do not use our site or services. 

1. Services Covered 

These Terms apply to the Eastside Paddle Club (ESPC) website, member portals, booking systems (PodPlay, CourtReserve), event registration, and related content. 

2. Eligibility & Account Creation 

You must be at least 13 years old to use our services. If under 18, you must have parental consent. You agree to provide accurate information and maintain account security. 

3. Membership, Bookings & Payments 

Memberships, bookings, lessons, and event registrations may require payment through third-party processors (e.g., Stripe). ESPC does not store payment card details. Availability is not guaranteed and ESPC reserves the right to cancel or modify services. 

4. Code of Conduct 

Users agree to follow all club rules, staff instructions, and safety guidelines. Harassment, misconduct, or unsafe behavior may result in immediate suspension or termination of access. 

5. Intellectual Property 

All content on the ESPC website is owned or licensed by ESPC and protected by copyright and trademark laws. You may not reproduce or distribute content without written permission. 

6. Disclaimers & Limitation of Liability 

The website and services are provided 'AS IS' without warranties. ESPC is not liable for damages, injuries, or losses resulting from website use, facility participation, or third-party services. Participation in pickleball or other physical activities carries inherent risks that users accept. 

7. Indemnification 

You agree to defend and indemnify ESPC, its staff, and affiliates from any claims or damages arising from your use of the website or violation of these Terms.

8. Termination & Suspension 

ESPC may suspend or terminate your account or access to services at any time with or without cause. Sections regarding IP, liability, and indemnification survive termination. 

9. Governing Law & Dispute Resolution 

These Terms are governed by Texas law. Disputes will be handled in Travis County, Texas courts. You waive rights to jury trial or class action to the extent permitted by law. 

10. Changes to Terms 

ESPC may update these Terms at any time. Updates will be posted on this page with a revised date. Continued use of services constitutes acceptance of changes.
